Dispute Resolution & Arbitration
Civil and commercial court representation, domestic and international arbitration, enforcement of foreign awards, and mediation.
In short
Tuhin & Partners represents clients in commercial disputes in Bangladesh: civil and commercial litigation in the courts, writ proceedings in the High Court Division, domestic and international arbitration, and the recognition and enforcement of foreign arbitral awards. Bangladesh is a party to the New York Convention, which is why a foreign award is generally on a stronger footing here than a foreign court judgment.
Key takeaways
- Arbitration in Bangladesh is governed by the Arbitration Act 2001.
- Bangladesh is a party to the New York Convention, so foreign arbitral awards from other member states can be recognised and enforced.
- A foreign court judgment does not enjoy the same treatment and may require fresh proceedings in Bangladesh.

Common questions
Are foreign arbitral awards enforceable in Bangladesh?
Yes. Bangladesh is a party to the New York Convention, and an award made in another member state may be recognised and enforced under the Arbitration Act 2001, subject to the limited grounds of refusal the Convention allows.
Can a foreign court judgment be enforced in Bangladesh?
Not automatically. Enforcement of a foreign judgment is materially harder than enforcement of a foreign arbitral award, and in many cases the claim has to be brought afresh before the Bangladeshi courts. This is the main reason commercial contracts with a Bangladeshi counterparty usually specify arbitration.
How long does commercial litigation take in Bangladesh?
Timelines vary widely with the forum, the complexity of the matter and the extent of interlocutory challenges, and ordinary civil suits can run for several years. Realistic advice on duration and recovery prospects is something to seek at the outset, because it often changes whether litigation is the right route at all.
Does Tuhin & Partners handle arbitration seated outside Bangladesh?
Yes. The firm advises on international arbitrations involving Bangladeshi parties and on the Bangladeshi law aspects of proceedings seated elsewhere, including the steps needed to enforce the resulting award here.
